1. Legal Terminology
“Operator” means WILD AFRICA SAFARI CO and any other safari operator, carrier, lodge, game reserve or person appointed by WILD AFRICA SAFARI CO for the SAFARI
“Safari” means the tour package, accommodation, safari, activity conducted by the OPERATOR
“Client” means the CLIENT of WILD AFRICA SAFARI CO
“Group” means 2 or more people who have booked together to participate in a SAFARI as a GROUP, each member being a CLIENT making up the GROUP

2. Health & Documentation
CLIENTS are advised to carry any prescription medication together with the script and in the original packaging.
It is the responsibility of the CLIENT to be in possession of a valid passport with at least two blank pages, required visas, vaccinations and other medical certificates where necessary.
The OPERATOR does not accept any responsibility for changes in regulations for visas or any particular travel pre-requisite. The OPERATOR cannot be held liable for the cost of delays or repatriation for the CLIENT should the CLIENT be refused entry to any country or if the CLIENT is restrained in any country for any reason whatsoever, he/she will have no claim for further carriage or refund against the OPERATOR.
Malaria prophylactics should be taken when entering Malaria areas.
The client undertakes to take precautions against the sun and heat.

3. Travel Insurance
Travel and cancellation insurance is mandatory for all CLIENTS.  THE CLIENT must arrange his/her own travel insurance for the full duration of the SAFARI. Insurance to cover injury, medical expenses, repatriation expenses, lost luggage, and associated expenses in case of the SAFARI cancellation. The OPERATOR shall not be liable to refund the CLIENT in the event of illness, loss of body parts or death.

4. Liability
The CLIENT understands that there are dangers that may be encountered on SAFARI.
The CLIENT acknowledges that the OPERATOR is under no liability to the CLIENT for any claim which may arise in connection with the SAFARI and the CLIENT renounces for himself/herself, members of his/her GROUP and dependants any and all claims against the OPERATOR for compensation for injury, damage, loss or death whether sustained on a vehicle, embarking or disembarking from a vehicle, in a game reserve, a lodge or elsewhere; or as a result of direct or indirect delays or otherwise to the CLIENT or the CLIENTS belongings, the GROUP and any dependants whether caused by any grossly negligent act or default or omission by the OPERATOR.
Whilst the OPERATOR undertakes to ensure all accommodation, food, tours, drinks and services are available as planned, the CLIENT shall have no claim of any nature whatsoever against the OPERATOR for a refund.  
All agents, servants and representatives of the OPERATOR are included in the exclusions and limitations of liability claimable.

5. Bookings & Payment
To confirm a reservation, a 20% deposit is required (unless stated on the individual package) to secure the booking.  On payment of the deposit, the CLIENT acknowledges and accepts on behalf of all their party the terms stated herein.
The balance of the payment must be made more than 30 days prior to the CLIENTS arrival.
Payments of all amounts due to the OPERATOR shall be made in South African currency or a currency acceptable to the OPERATORS bankers, free of any deduction on the due date.
No contract shall exist between the OPERATOR and the CLIENT until the prescribed deposit has been paid and the booking confirmed in writing by the OPERATOR. The CLIENTS deposit will be refunded should the company not be able to accommodate the client on the requested SAFARI.

6. Cancellation by the CLIENT/Amendment by the CLIENT
Cancellation of the SAFARI is to be in writing and is only effective on receipt of such notification.
Cancellation more than 4 weeks prior to arrival – forfeit the deposit
Cancellation less than 4 weeks prior to arrival – forfeit the full amount
Amendments after the booking has been confirmed will be subject to a transfer fee of US $50 should you wish to change to an earlier departure date.

7. Cancellation by the OPERATOR
The OPERATOR reserves the right to cancel the SAFARI, in any circumstances. In an instance where the OPERATOR cannot provide the SAFARI booked, the OPERATOR will return to the CLIENT all monies paid, which shall constitute the full extent of the OPERATORS liability to the CLIENT.

8. Early Termination and Alterations to Itineraries
If for any reason the CLIENT no longer wishes to participate with the SAFARI, including injury or illness, then the CLIENT shall at his/her cost make his/her own travelling arrangements.  If the OPERATOR, due to a consequence of a CLIENTS injury or illness, deviates from the proposed route, the CLIENT shall be responsible for all additional costs arising from the deviation.
All brochures, pamphlets, and web advertising are correct at the time of printing, but may be changed or withdrawn without notice.
The OPERATOR reserves the right to alter an itinerary after the departure if it is in the CLIENTS interest to do so.  The OPERATOR will not be held responsible for any compensation to the CLIENT if the OPERATOR has to change or cancel the SAFARI in any way due to force majeure, namely war, civil riots, industrial disputes, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or external circumstances beyond the OPERATORS control.
The performance of a SAFARI can be affected by weather, road conditions and mechanical breakdown or by any other unforeseen occurrence beyond the control of the OPERATOR. It is recommended the CLIENT take out travel insurance to cover the eventuality of missed flights, extra accommodation, meals and personal expenses as the OPERATOR cannot be held responsible for any compensation to the CLIENT.
The OPERATOR reserves the right to change any of the facilities or vehicles described in the SAFARI, without becoming liable for compensation or refund.

9. Authority on SAFARI/Exclusion on SAFARI
The CLIENT agrees to adhere to all instruction given by the OPERATOR whether verbal or printed. The decision of the driver of the OPERATOR will be final in all matters likely to endanger the safety of the CLIENTS. The OPERATOR shall not be held responsible for or liable to any CLIENT who commits an illegal or unlawful act in the country visited. The CLIENT may be excluded from the SAFARI without any refund of the SAFARI.
If the CLIENT breaches any obligation in terms of this agreement or if the CLIENT constitutes a nuisance to the OPERATOR, the OPERATOR shall be entitled to terminate the CLIENTS group and refuse to permit the CLIENT or any member of his group to continue with the SAFARI. In these circumstances the CLIENT and members of his/her group will be responsible for the cost and travel arrangements from the point of termination.  The OPERATOR shall not be liable for any claim for transport and expenses of any nature, nor shall the OPERATOR be liable to make any refund to the CLIENT.

10. Environmental Issues
The CLIENT agrees and undertakes to preserve the environment and not litter, pick wild flowers or vegetation, remove rock, coral or any other part of the natural environment.
The CLIENT undertakes to take all safety measures to avoid fire hazards.

11. Alterations
No employee or representative of the OPERATOR has the right to alter, vary, or waive the right of these conditions, nor to undertake any liability whatsoever on behalf of the OPERATOR, unless such be in writing and signed by the director of the company.

12. Baggage & Equipment
The OPERATOR shall not be held liable for any loss or damage of any nature to the CLIENTS baggage and/or goods howsoever caused.
CLIENTS are restricted to one suitcase weighing not more than 20kg and one hand baggage item, which IATA airlines allow passengers to carry on board the aircraft. In the event of there not being sufficient space in the vehicle or aeroplane for excess baggage, the CLIENT will be responsible for the cost of transporting/storing the excess baggage.(Please note that individual safaris may have different luggage restrictions which will be advised on booking)

13. Jurisdiction and Law
This contract shall be interpreted under the laws of South Africa.

14. Photography
The OPERATOR reserves the right to take photographs or films of our clients on SAFARI, and publish or use the material in advertising, without obtaining the consent of the CLIENT or payment to the CLIENT.

15. Safari Tour Exclusions
Personal expenses such as alcoholic spirits (unless otherwise indicated), laundry, telephone calls, room service, a la carte meals, tips to waiters/hotel staff, gratuities to drivers/guides/rangers and trackers, and any item not specified by the OPERATOR.
